Resumo
Este artigo analisa os regimes excecionais de regularização voluntária (RERT) instituídos pelo legislador nacional na primeira década do novo milénio: a sua natureza jurídica e teórica; e algumas das questões práticas (RERT parcial, sigilo fiscal, amplitude da amnistia, direito de não autoincriminação) que se suscitarão, pelo carácter invulgar do instituto e pela dificuldade de interpretação da lei, tanto maior porque esta matéria produz efeitos e encontra-se na fronteira entre o Direito Fiscal e Direito Criminal.Palavras-chave: RERT; regularização, fraude fiscal, imposto
Abstract
This article studies the Portuguese legal exceptional and volunteer regularization regimes (RERT) created in the first decade of the new millennium: their juridical and theoretical nature; and some practical issues (partial regularization, tax secrecy, extent of the amnesty, right of non-self-incrimination) that will raise due to the unusual nature of the institute and the difficulty in interpreting the law, even eighter because this theme is in the borderline between the tax law and the criminal law.Keywords: RERT, regularization; tax fraud; tax
