Resumo
Este artigo discute a aplicação do artigo 47.º da Carta dos Direitos Fundamentais da União Europeia em matéria tributária, em especial no que respeita à jurisprudência do Tribunal de Justiça da União Europeia nesta temática. A análise da jurisprudência encontra-se divida por grandes temas: a aplicação do artigo 47.º da Carta no âmbito da cooperação administrativa e assistência mútua no domínio da fiscalidade; a utilização pelas autoridades tributárias de provas obtidas no âmbito de processos penais; e os custos financeiros no acesso aos tribunais. Por último, são elaboradas algumas conclusões críticas quanto às linhas orientadoras traçadas pelo Tribunal de Justiça da União Europeia, na interpretação do artigo 47.º da Carta dos Direitos Fundamentais da União Europeia em matéria tributária.Palavras-chave: Carta dos Direitos Fundamentais da União Europeia, Direito à acção e a um tribunal imparcial, Tribunal de Justiça da União Europeia, Direitos dos Contribuintes, Direitos Fundamentais
Abstract
This article discusses the application of Article 47 of the Charter of Fundamental Rights of the European Union on tax matters, in particular regarding the case-law of the Court of Justice of the European Union on this issue. The analysis of the case-law is divided into major themes: the application of Article 47 of the Charter to the administrative cooperation and mutual assistance in the field of taxation; the use by tax authorities of evidence obtained in criminal proceedings; and the financial costs of access to the courts. Finally, some critical conclusions are drawn on the guidelines drawn up by the Court of Justice of the European Union on the interpretation of Article 47 of the Charter of Fundamental Rights of the European Union.Keywords: Charter of Fundamental Rights of the European Union, Right to an effective remedy and to a fair trial, Court of Justice of the European Union, Taxpayers’ Rights, Fundamental Rights
